CASE DIGEST ON GLOBE MACKAY V. CA [176 S 778 (1989)] - While an employer has the right to dismiss an employee who was involved in anomalous transactions, the right of dismissal should not be exercised in an abusive manner, such as by making accusations of being a crook, forcing him to take a forced leave, threat¬ening to file a hundred suits against him. Hence, the employer is liable for damages.
Art. 21 was adopted to remedy the countless gaps in the statutes, which leave so many victims of moral wrongs helpless, even though they have actually suffered material and moral injury. This article should vouchsafe adequate legal remedy for that untold number of moral wrongs which it is impossible for human foresight to provide for specifically in the statutes.
